Real Property Registration System in Japan

The real property (real estate) registration system differs in content depending on the country.
In Japan, land and buildings are treated as separate and distinct real property, and registration can also be made separately. This way of thinking and system are similar to those in Taiwan and South Korea. Whereas buildings are considered attached to land in Western countries and rights establishment, registration and transaction cannot be made for solely buildings.
In addition, the indefeasibility of registration also varies depending on the country.
Here is a brief explanation of the real property registration system in Japan.

About Real Property Registration in Japan

Real property registration is a system for land and buildings, being valuable property, in which the location, the owners' address and name, etc. are stated in a public book (registry).
It is made open to the public, thereby serving the role of making the rights relationship and other status clear to everyone and contributing to the safe and smooth conduct of transactions.
Pursuant to the Real Property Registration Act, there are nine types of rights that can be registered: ownership, superficies, farming right, servitude, statutory lien, pledge, mortgage, right of lease and right of quarrying.
Registrations cannot be made for right of possessory, right of common, right of retention and right of loan for use.
As mentioned above, land and buildings are treated as separate real property, and registration can also be made separately.

Effect of Registration

(1) Perfection
Acquisitions of, losses of and changes in real rights concerning immovable properties may not be asserted against third parties, unless the same are registered pursuant to the applicable provisions of the Real Property Registration Act and other laws regarding registration (Civil Code Article 177).
The order of priority of rights registered in relation to the same real property shall, unless otherwise provided for in laws and regulations, follow the chronological order of registration (Real Property Registration Act Article 4).

(2) Indefeasibility
A party who has engaged in a transaction of real property having trusted the description in the registration is entitled to acquire such rights under certain requirements even if the registered right holder does not seem to be the true right holder.
Indefeasibility does not apply to registration in Japan.
Accordingly, no matter if real property is purchased from a registered right holder thinking that the registered right holder is the true owner, real property cannot be taken away from the true owner if there is a true owner.

FAQs -Part 3-

Is it possible to let out the property except when I am staying in Japan?

Yes, it's possible.
For example, if you want to stay in Japan after one year, you can rent the property on a non-renewable one year lease first.
However, it's difficult to find a tenant for a non-renewable lease and you may need to lower the rent. It wouldn't make good return.
Therefore we recommend that you do not let out the property for your stay.



Japan is an earthquake-prone country.
How to control the risk for the property investment?

Due to high frequency of earthquakes, the building regulations related to structures are quite strict in Japan, especially since 1981.
If you want to mitigate the risk, it is recommended to choose properties which permitted to be built after 1981.
Also, you can insure your property against earthquakes.


I'd like to buy a property to live in.
How long will it take to move in?

It depends on the current status of the property.
If it is vacant, you can move in after signing the sales contract and paying the remainder price.
In cases where it is occupied by the seller, it may take about three months after signing.




How do real-estate brokerages search properties for sale?

We search properties through the nation-wide real estate database system called REINS, which stands for Real Estate Information Network System.
All real-estate brokerages in Japan have access to REINS and it is updated everyday.
Therefore, we can find properties meet which your requirements.
Conversely, it enables you to find buyers all over Japan when you sell properties.

What are 'management fees' and 'repairing funds' of apartments?

Management fee is used to maintain the quality of the shared elements of an apartment, such as regular cleaning of common use spaces and maintenance of lifts.
Repairing fund is reserved for future major repair of the shared elements such as external walls and a roof which take place once every 10 to 20 years.
It is collected every month to prevent it from becoming a large expenditure.

I don't understand Japanese at all.
Is it possible for me to purchase properties in Japan?

Yes, it's possible and your Japanese language skill shouldn't matter.

To be honest with you, it is depends on your style of investment.
If you prefer to gain stable income with a low risk, areas within the Yamanote line such as Chiyoda-ku, Minato-ku, Bunkyo-ku and Shinjuku-ku would be options.
For investors looking for high returns, areas outside the Yamanote line might be choices.
If you seek higher status, the luxurious shopping district, Ginza, and upscale residential areas in Minato-ku like Azabu, Hiroo and Roppongi are recommended.
To invest in Tokyo Olympic's economical impact, Harumi, the site of the Olympic Village and sightseeing spots like Asakusa are good.

FAQs -Part 1-

Do I have to visit Japan to buy properties?

No, it's not necessary to visit Japan but we recommend viewing the property especially if it is your first time buying property in Japan.
If you are unable to visit Japan, we will provide photos, analysis and detailed information of properties as much as possible to support your decision.


What do 1R, 1K, 1DK, 1LDK, 2LDK and 3LDK mean?

These are terms refer to the layout of residential properties.
The "1R" is a studio type unit which has a kitchenette within a room.
The "1K" is also a studio type unit but there is a separation between a kitchenette and a room.
The "1DK" is one bedroom unit with a dining room and a kitchen, the kitchen is open to dining room in almost every case.
The "1" of "1LDK" indicates the number of bedrooms, while the "L" stands for "Living room", "D" for "Dining room" and "K" for "Kitchen", and a living room, dining room and kitchen are open plan in most cases. The same applies to 2LDK and 3LDK.
It is normally separately indicated whether or not there is a bathroom, but usually there is a bath and a separate toilet for layouts greater than 1LDK. In general, bedrooms are not connected with bathrooms and there is one common bathroom.


What are the major differences in layouts and finishes of residences between Western styles and Japanese styles?

As mentioned above, bedrooms are not connected with bathrooms in most residences in Japan.
In general, there are several bedrooms with closets and one common bathroom. The layout of bathroom is also very unique to Japan. As shown in the figure below, bathtub with shower, wash basin and toilet are located in separated rooms.


When it comes to the finishes, the most commonly used floor finish is MDF (engineered wood) floor. It is uncommon to have tiled or stoned floor for residences in Japan since people do not wear shoes indoors.

Although, there are flats which have Western style layouts and finishes available in areas popular among expats, like Azabu and Roppongi.
Also, it is possible to remodel properties according to your preference and we are happy to assist.
